When you have pursued your studies in Canada
and you are being an international student, you would usually try every of the
ways to continue your stay in Canada legally. Here are 3 different options that
you may go for:-
- Employer-Specific Work Permit
- Open Work Permit
- Direct Permanent Residence
Let us take a look at how these three options work for you:-
1. Employer-Specific Work Permit
This
process comprises finding an employer, applying for and obtaining an
employer-specific work permit, working in Canada, and, eventually, qualifying
or and applying for PR. The best way to make it out is that the international
student experience may help you build contacts with potential employers before
completing your degree. You may also opt for beginning your job search within
Canada during your student days and line up an offer as soon as your study
permit expires so that you maintain continuous status.
This option works well for you when you are not otherwise eligible for permanent residence, and your program of study does not make you eligible to apply for a Post-Graduation Work Permit (PGWP). Also having a job offer lined up would result in a longer-duration work permit than the PGWP you are eligible for.
2. Open Work Permit
In
place of an employer-specific work permit, an open work permit helps you to
work for any eligible employer anywhere in Canada for as long as it is valid.
It’s very easy to switch jobs and having your legal status in Canada doesn’t
get you tied to your employer or position.
It
is quite attractive as the international students have available option of
applying for a specific type of open work permit—the Post-Graduation Work Permit (PGWP).
The
validity of PGWP period is linked to the duration of your study program. The
persons who are studying for less than eight months in Canada are not eligible
to apply for this permit. When you are studying an eligible course for two
years or more, then you may be permitted to work for any eligible Canadian
employer for three years.
When
you are opting to study in a course longer than 8 months but less than 2 years,
then the permit will be valid for the actual duration of the course. For
instance when you are studying for 15 months, then the permit will have a
validity period of 15 months.
Sometimes,
multiple programs can be compiled together. For instance, when you have gone
for completing a a one-year degree or certificate in Canada and then, within
the next two years, you complete another one-year program in Canada, that would
count as two years of studies, and you could be eligible for a PGWP valid for
up to three years.
While
determining your validity period, all eligible courses that you completed in
Canada will be considered together. When
you complete two one-year programs for a total of two years will make you
eligible for a three-year PGWP.
When you are eligible to apply for a PGWP, even if you have a job offer from an employer in your field, a PGWP is still usually the better option, since it allows you to change employers, or change positions with your employer,
3. Direct Permanent Residence
Most
of the international students can apply directly for Canadian permanent
residence (PR) without work experience through the one of following programs:
- Quebec Experience Class
- International Graduate Stream of various Provincial
Nomination Programs
- Atlantic Immigration Pilot Program
Quebec
Experience Class (PEQ)
You may be eligible to apply directly to the Quebec Experience Class (PEQ – Programme de l’experience quebecoise) when you have completed your studies in the province of Quebec
The
primary requirements to apply under PEQ include:
- Having
eligible degree/diploma from recognized Quebec institution of duration of
at least 1800 hours (equivalent to course duration of two years)
- Having
resided in Quebec for at least half the duration of the program
- Having
advanced intermediate knowledge of oral French
- Aged
above 18 years and being a legal resident of Quebec.
- Intending
to settle in Quebec to hold a job.
- Applying
within 36 months of receipt of confirmation of completion of the
degree/diploma.
The
most attractive feature of this program is that you can obtain permanent
residence solely on the basis of your experience as a student in Quebec. PEQ
applications are also prioritized by the Ministère de l’Immigration,
de la Diversité et de l’Inclusion (MIDI),
You may be eligible to apply for a Quebec Selection Certificate (CSQ – Certificat de sélection du Québec) when you fulfill these requirements. After getting approved, you can then apply to the federal government for permanent residence.
In
this way, your application gets processed quickly. . That, combined with being
eligible to apply straight out of school, makes PEQ one of the fastest pathways
to permanent residence in Canada.
This option works well when you studied in
Quebec and have French language proficiency.
Provincial Nomination Programs (PNPs)
Each
province of Canada operates its own Provincial
Nominee Program (PNP) immigration streams.
Similar to Quebec, successful PNP applicants receive a nomination from the
province they applied to, which can then be used to apply for permanent
residence.
Many
provinces have PNP streams specifically to help retain international graduates
in the province! Alberta, British Columbia, Manitoba, Newfoundland and Labrador, Ontario, Prince
Edward Island, and Saskatchewan each have International Graduate programs that
offer pathways to permanent residence.
Here
each program is different. Some International Graduate PNP streams need that
the applicant have graduated from an eligible school in the province, while
other ones are for graduates from anywhere in Canada.
Some
of the PNPs require some work experience in the province or in Canada, and
others may require that international graduates have a valid job offer. Some
even require that applicants be in the Express Entry pool
before they can apply!
Many provinces have PNP streams specifically to help retain international graduates in the province! Alberta, British Columbia, Manitoba, Newfoundland and Labrador, Ontario, Prince Edward Island, and Saskatchewan each have International Graduate programs that offer pathways to permanent residence.
This works well for you when the province in
which you studied has a PNP stream for which you are eligible!
In
order to initiate and help the economy of Canada to grow, the Atlantic Immigration Pilot Program (AIPP) was launched in 2017. It has an
International Graduate stream that is similar to PNPs. It grants PR (permanent
residence) to international graduates from recognized publicly-funded educational
institutions in the Atlantic region who have a valid job offer from an employer
in the region.
Here
are the points on which this Program differs from many of the streams offered
by conventional PNPs:
- The
province must endorse the job offer
- There is
no LMIA required
- There is
a needs-based assessment and creation of a settlement plan for the
applicant
- Employers
must provide support for the long-term integration of the applicant and
their family
- Prioritized
processing including the option to grant a temporary work permit on basis
of undertaking by applicant to file for permanent residence within 90
days.
